This article explores why more and more covered entities ("CEs") and business associates ("BAs") may be forced to do a greater number of Risk Assessments per year than first anticipated. The Security Rule generally indicates that a Risk Assessment ("RA") must be done "as required" (e.g. when your operational environment changes OR if, as a practical matter, your organization has never actually done an RA and it is trying to comply with Meaningful Use objectives).

The Case for Near Real-Time Risk Analysis?

However, because the threat landscape changes on a real time basis, an RA completed a month ago is likely to be obsolete (e.g. not much use in actually helping the organization prevent a breach). In other words, you may not be "dinged" for not having performed an RA "recently" BUT you nonetheless are going to incur all of the PAIN that accompanies a significant breach of PHI.

The threat landscape is now a Big Data Problem and must be dealt with as such if security teams have any chance at all in coping with the challenge. The white paper below from Risk I/O is worth the read. Here's a summary:  

 

The challenge security teams face managing and remediating security defects has evolved in recent years. Finding vulnerabilities is no longer the challenge. Organizations face a number of issues as part of their vulnerability management programs, not the least of which is data management. Mature security teams are assessing risk across all of their asset layers including their applications, databases, hosts and networks. Any group dealing with a sizable environment isn't struggling with finding security defects, but rather with managing the mountain of data produced by their vulnerability assessments, penetration testing, and threat modeling in order to fix what's most important first.

However rigorous this approach may be, it is currently mostly out of reach for the vast majority of CEs and BAs in the marketplace (e.g. that don't have any in-house HIT staff, let alone a dedicated security team). That's the bad news. The good news is that we believe there are any number of vendors in the process of developing offerings that make these kinds of solutions available to the masses, likely through a "remote monitoring" SaaS based solution.

Key Contract SectionsWhat Does it Take to do an RA? 

 

We provided an answer to that question in our November 2013 article entitled "Risk Assessments: A Foundational Methodology." However, the challenge we are focused on here is how does a CE or BA compress these steps into a near real-time process? That kind of compression is a difference in kind and not just degree. It requires re-thinking an organization's RA strategy and the entirety of its Risk Management Program.
