Our article this month is entitled:  HIPAA Business Continuity: a Common Sense Approach 

 

This article discusses Business Continuity requirements under the HIPAA Security Rule ("SR"), which pertains to all of a covered entity ("CE") or business associate's ("BA") electronic protected health information ("ePHI").

 

According to the Security Rule there are five basic steps to developing (and testing where applicable) a Business Continuity Plan:

  1. Data Backup Plan ("Required").
  2. Disaster Recovery Plan ("Required").
  3. Emergency Mode Operations Plan ("Required").
  4. Testing and Revision ("Addressable").
  5. Applications and Data Criticality Analysis ("Addressable").
These requirements can be found at §164.308 (a)(7)(i) Contingency Plan; a Security Rule ("SR") Standard.

HITECH / HIPAA NewsletterRequired v. Addressable?

 

According to the SR's General Rule, a "Required" implementation specification is one that ALL CEs and BAs must implement; absolutely no exceptions. An "Addressable" implementation specification must be implemented, or a substitute must be implemented; or a compelling reason must be documented as to why your organization elected not to implement anything at all (generally not a good idea).

 

Although we have often made the argument that the SR's "flexibility principle" really does not provide that much flexibility, this is one case where in fact it might. There are a number of reasons why we believe this is true and we will elaborate on same later in the article.

Key Contract SectionsData Backup Plan? 

 

If you don't already have a Data Backup Plan ("DBP") in place, then you are truly "walking a high wire without a net." The risk here is far more than not meeting a HIPAA compliance requirement, rather it's a real threat to the viability of your business

 

For the sake of argument, let's assume that you do in fact have some sort of DBP in place, the real questions are: (1) what are its attributes? and (2) how do you know that it is working?
