Webtones Pointer If a significant part of your operations involves transacting with a covered entity (CE) as a business associate (BA) then this article should bring to light (and confirm) what you may be seeing from a regulatory compliance perspective in the quickly evolving healthcare landscape.

More and more covered entities are waking up to the fact that this is "Simply NOT your Daddy's HIPAA any more." Yes, we all know that the industry's "awakening" has been a long slow work in progress. We also realize that more than a few "Docs" have threatened to "retire instead of complying." However, by and large these comments are now correctly viewed  as fringe statements made by "grumpy old Docs" and/or those Docs that have been "banking" and can actually afford to retire (God Bless 'Em).

 

All kidding aside, we take our hats off to all those healthcare workers, including the "grumpy Docs," that go out and fight the good fight on a daily basis. None of us like it when someone moves our cheese, and in healthcare, sometimes it feels like the cheese has not only been moved, but someone actually had the audacity to eat it. It just ruins your day. There you have it, we now live in this 24/7 "always on" online universe and there is simply no retreating to the good 'ole days. 

 

For the reasons enumerated below, as a business associate you have no choice other than to make the best out of the regulatory compliance hand that you have been dealt. You somehow must manage to make lemonade from lemons. If you can't your competitors will. You can either be the the "disruptor" or the "disruptee." The former is preferable.

Indeed. As covered entities discover en masse that the HITECH Act is here to stay and that HITECH really does represent a HIPAA game changer, then their collective view of the world is going to change accordingly. As a business associate what this means is that CEs are going to expect a LOT more assurances that you are in compliance going forward. In fact, they will want to see visible, demonstrable evidence of compliance. This is true despite the fact that many CEs themselves may still be pursuing one of the five compliance strategies guaranteed to fail.

 

Key Contract Sections In short, business associates that understand the magnitude of the compliance challenge the industry faces have a window of opportunity to seize that mantle of thought leadership within particular niches and thereby differentiate their offerings in the marketplace. CEs are struggling with their own initiatives and won't have much patience for business associate education.
